New Resolutions

 

The majority of the people and companies start the New Year with good resolutions. This includes the editorial staff of the M & P - Newsletter, who are now celebrating 11 years of publication. Which means we must being doing something right! Our real estate rivals, as well as other media, have been known to copy us, without quoting the source. Usually, only the “best” are copied.  In 2018, we will continue to discuss the current topics of building and investment; economy; law, tax and finance as well as information on the Galeria de Arte Minkner and all other interesting events. The chaos of the Balearic government will certainly continue! Our goal for 2018: is “Always better and different from the rest!”.

2. Mallorca – Construction/Investment; Economy; Finance; Law and Taxes

 

(1) Construction / Investment

 

Arenal: Municipality of Llucmajor presents project "Agora 4.8" for the upgrading of the Playa de Palma

 

We have been bothered in recent years with projects to upgrade the Playa de Palma. Commissions were used, citizens interviewed, money wasted. Except expenses, nothing has been. Now the town hall of Llucmajor introduces a project "Agora 4.8". It was designed by the architects Catalina Salva (Mallorca) and Hector Ortin (Barcelona) and won European 14, a young newcomers competition. 1,000 entries had been presented for discussion. The project aims to connect public spaces and green areas, thus creating a multifunctional space. Whether the project will ever be developed, is in the stars. So far, all efforts to upgrade the Playa de Palma failed due to lack of finance.

 

Puerto Andratx: town hall will become responsible for the urbanisations (except La Mola)

 

After years of discussions between the town hall and the construction company Acciona over the execution of infrastructure measures in the urbanisations around Puerto Andratx, an agreement has now been reached between both parties. This agreement means that the town hall is now responsible for the maintenance and repair of the infrastructure. Excluded from the agreement is the urbanization La Mola, which still has no infrastructure. However, work on the construction of the sewage system is to start here this year.

 

Campos/ Es Trenc: town hall will build portable Chiringuitos (beach bars)

 

In the summer of 2017, the nature conservation area of Es Trenc - Salobrar was legally established.

Shortly before this happended, the existing beach bars (Chiringuitos) were all demolished, because massive buildings are prohibited in a conservation area. The six new Chiringuitos will be portable and thus dismountable, they will be made of wood, and will no longer be located in the dunes, but on the beach. The Chiringuitos will have a maximum size of 20 m² and 50 m² terraces, including 2 toilets. The Municipality of Campos is currently working on licensing conditions. The new Chiringuitos will begin to operate at the beginning of the 2018 high season.

 

Sa Pobla park and ride – 50 new parking spaces are to be built at the station

 

The Balearic Ministry of Transport, has decided to build 50 parking spaces, on an area of 1,900 m² at Sa Pobla train station. The work will be completed in spring 2018. The investment will be in the region of €100,000. The new "Park and Ride - System “will be an incentive for the residents of Sa Pobla, many of whom work in Palma, to leave their vehicle at the station and use the train. Until now, there has been limited parking space close to the station area, so many people had to use their own vehicle to drive to work.

 

Felanitx: 3 new hotels to be constructed

 

Until recently, the little village of Felanitx, located along the southeast of the island, did not have a hotel! Very soon there will be three hotels and applications for licenses are currently being processed in the Felanitx Town Hall. Existing old buildings will be renovated and converted, these will be the Casal Can Vell, as well as another building in Carrer Pere Catany and another in Carrer Major.

The largest of the three hotels will be Casal Can Vell which will be a 4 star hotel with 17 rooms

 

Palma: ANEA: Balearic Airports will be investing 41 million euros for passengers with limited mobility

 

The airport operator AENA will be investing 41 million euros over the following four years to help passengers with limited mobility to use the airports. For this purpose, the technical equipment and facilities, as well as services for disabled people are to be renewed and improved. The services of the company Multiservicios Aeroportuarios S.A. is already in great demand: from January to November 2017, 135,000 people used the services of this company.

 

Cala Pi/ Vallgornera: The town hall waives the planned sewage connections so as not to endanger the caves

 

For years in the Llucmajor, the subject of the sewerage system of Vallgornera and Es Pas next to Cala Pi, at the southern tip of Mallorca, has been under discussion. Directly below the urbanisation is a dendritic cave system. Originally, it was planned to lay the waste pipes through the cave system in accordance with the specifications in the zoning plan. An evaluation from the Spanish Institute of Geology IGME, pointed out that the urbanisations were on porous ground, which would be further destabilised by the installation of a sewerage system. Based on this evaluation, the town hall has now decided to dispense with a new sewage system for the affected areas and to leave it with the present disposal systems already in use.

 

(2) Economy

 

Growth of the Balearic economy in 2017 was 3.8%

 

The Ministry of Economy of the Balearic Islands has issued a provisional report on 2017 which shows an increase in gross domestic product of 3.8% compared to the previous year. In the past three years, gross domestic product has increased by 7.3%. For 2018, the Balearic Ministry of Economy predicts a growth of 3.5%. The Ministry justifies this forecast by including in it that the improved collective agreements in the hotel and catering industry, which increase purchasing power, have been agreed upon. In addition, the government is assuming that significantly more jobs will be created this year.

 

Rental prices in Mallorca increased by 22.1% in 2017

 

Readers of the M & P Newsletter have been following the discussions about the new Tourism Act and the regulations on holiday rentals in the last few months. The use of apartments for the purpose of vacation rentals has led to a shortage of rental apartments. This resulted in significant increases in rents. In 2017, rents in the Balearic Islands increased by 22.1% according to a survey of the real estate website Idealista. The average rental price per m² was 12.50 euros. Spain's increase was 18.4%.

 

Mallorca flights: Eurowings is upgrading

 

Eurowings, the subsidiary of Deutsche Lufthansa, has already significantly increased its number of flights to Mallorca following the AirBerlin bankruptcy. Nevertheless, the demand for flights to Mallorca could not be met. To remedy this, Eurowings will offer special flights with wide-bodied jets (Airbus A330 with a seating capacity of 330 seats) from now until March 2018, namely twelve special flights from Cologne / Bonn and twenty-two from Düsseldorf.

 

(3) Law, taxes, and finances

 

Legislative marathon in Spain

 

In the last 10 years, a legislative marathon, caused mainly by the Spanish economic crisis, has taken place. Although the crisis has largely been overcome, the Spanish legislature is still European champion and according to an article in the Spanish magazine “Expansion” from December 2016, passed 10 times more laws than the Federal Republic of Germany! Even though Germany has almost twice as many inhabitants as Spain! Spain's "General Council of Economists" (Consejo General de Economistas) even speaks of a "legislative bubble", which will also permanently damage the legal security of Spain. Economists argue that poor regulatory quality leads to legal uncertainty and a rise in litigation. Legal certainty stimulates new investment and productive resources, creating wealth and jobs.

 

In the future there will no right to continue after eight years for illegal buildings in rural areas (suelo rustico)

 

During the meeting on 5th December 2017, the Balearic Parliament adopted a new law on land use (Ley Urbanistica de las Islas Baleares, LUIB). It should simplify and speed up planning and provide legal certainty. For illegal building, the penalties were significantly increased. In extreme cases, they can amount to 300% of the value of the illegal construction project. In addition, the demolition of illegal buildings should be enforced more quickly. If the communities fail to enforce demolition and punishment quickly enough, the island council can take over the responsibility.

 

An important change applies to illegal rural buildings (on suelo rustico). So far, it was the case that an illegal construction (including annexes and modifications) enjoyed grandfathering rights eight years after completion, and therefore could no longer be sanctioned or demolished, unless an administrative offense procedure had been initiated within these eight years. This statute of limitations of eight years will not exist in the future. However, there is a prohibition of retroactivity, according to which illegal buildings, which exist on 31.12.2017 already eight years after completion, may not be sanctioned. In the future there will be a risk of demolition and criminal decree on all illegal structures on suelo rustico, which are not yet eight years old on 31.12.2017.

 

Attention: The amendment is only valid for illegal buildings on suelo rustico. For buildings in the urban area (suelo urbano), the existing rights of eight years also extend beyond 31.12.2017 for illegal buildings.

 

Intensive investigations on illegal holiday rentals:

 

The financial authorities of the Balearic Islands have increased their number of staff in order to combat illegal holiday landlords. As many of the rentals are handled through internet websites (AirBNB, HomeAway, Wimdu or Niumba), these websites have now been required, as of on 1st July 2018, to forward to the tax authorities data on the owners of the illegally rented apartments. These must include names of the owner or owners, address of the real estate agency, cadastral numbers,

plus, the number of days, the holidaymakers were renting the property. These measures will allow, taxes on rentals as well as the due tourism taxes to be collected.

 

Shipping companies protest against the tax on tourism for cruise tourists

 

At the beginning of the year, according to the wishes of the Balearic Government, tourists on cruise ships, who are in port less than 12 hours, must pay the tourism tax. The International Association of Cruise Shipping Companies (CLIA) have vigorously protested against this new regulation. The new regulation creates a dangerous competitive disadvantage compared to other competitors in countries such as Turkey, Tunisia or Egypt. The Balearics and Catalonia are the only destinations in Europe to demand such a levy.

Life is beautiful – Folk Art & Assemblage

 

The term "naive painting" or Folk Art, was originally used to describe works by self-taught people who represented their environment in a simple, carefree way. At the beginning of the last century, the style became "Naïve Art"/Folk Art. The Galeria de Arte Minkner presents in its new exhibition, four representatives from this type of art direction. First there is Diego Arango Arango, the Colombian painter who lives in Mallorca ". He paints from a childs perspective and belongs to the group of sophisticated folk artists. Hanne Holze has made a name for herself with her folk art depictions of people and subjects on the island. The Polish painter Stefan Popowski is known for his folk art depictions of peasant and rural topics. The Hamburg artist Otto Quirin, who has lived for a long time in Catalonia (Barcelona and Girona), and is well known for his wonderful paintings of *bathing and beach scenes. Finally, there are the assemblages of the deceased artist Prof. Jürgen Wölke, three-dimensional images of everyday scenes from Berlin and Palma.

HERMAN – „Gans schön sonnig “– new works by the popular pop artist

 

Since the 4th of June 2017 the artist from Paderborn HERMAN, one of the most important German pop artists, has been exhibiting his works in the Galeria de Arte Minkner in Santa Ponsa. New works - unique and limited editions. Especially Herman’s play on words - image games always captivate the spectators and viewers of the pictures, force a smile or reach deeply in our hearts. This time, the mix of earlier Herman works (from the year 2002 and in the gallery) with the current "fresh work" from his studio is especially attractive.

You can see the almost incredible development of the artist and the perseverance of the original Herman style. He himself has hardly changed (he says): a funny-spontaneous entertainer with a huge portion of self-irony.
